PLEA Member Vindicated at PERB

On October 18th, 2011 the Phoenix Employment Relations Board (PERB) accepted the hearing officer’s report reference Officer James Holmes being wrongly transferred out of the Public Affairs Bureau due to him being a PLEA member. The management representative on the board insisted that language be added to the report to “strongly recommend” that the Department return Officer Holmes to the Public Affairs Bureau as a Public Information Officer. (PIO) The consensus among the board was that the Department has to ensure that Officer Holmes is made “whole” so that it sends a message that this type of behavior by Police Department Management is unacceptable in the future. Police Chief Joe Yahner immediately agreed to move Officer Holmes back to his old position of PIO effective this upcoming Monday. PLEA would like to thank Chief Yahner for his quick action in this matter. Officer Holmes was represented through the process by PLEA Treasurer/Chief Negotiator Will Buividas and PLEA President Joe Clure. PLEA would also like to thank attorney Mike Napier for the superior job he did representing Officer Holmes and PLEA during the PERB hearing.
